In the event of a dispute that cannot be resolved, the Commercial Court of Romans will have sole jurisdiction.
These general terms of use are subject to French law, which shall determine the applicable laws on a case-by-case basis.
General Terms of Advertising
Acceptance of the General Terms of Advertising
By placing an advertisement (hereinafter an “Advertisement”) for publication on Appartement-meuble.net, website published by LMP Finance, the advertiser shall be deemed to have unconditionally accepted these general terms of advertising. This expressly excludes any additional or contrary terms and conditions of LMP Finance’s co-contractors contained in their informative documents, letters, contracts, etc., received or pending receipt and any professional practices that are contrary hereto. Such terms and conditions and practices shall be deemed unenforceable against LMP Finance.
Any addition, deletion or modification that may be made hereto must be signed by LMP Finance in order to be binding upon it.
Failure by LMP Finance to enforce any of the provisions of these general terms of advertising cannot be construed as a waiver on its part to enforce such a provision at a later date.
Advertising
The advertiser acknowledges that it is the sole and exclusive author of the description contained in the Advertisement. Failing this, it warrants that it has all rights and permissions necessary to publish the Advertisement.
The Advertisement shall be published under the sole responsibility of the advertiser.
The advertiser warrants and represents that the information provided is accurate and does not contain any errors or omissions that may be misleading or dishonest. LMP Finance, as publisher of the website, may not be held responsible in any way whatsoever if the information contained in the advertisement or if the quality of the advertiser is inaccurate.
We only publish one property per advertisement. The descriptions, phone numbers and prices displayed in the advertisements may be modified free of charge while they are published on the site. However, the original property described in the advertisement must remain the same and may not be replaced by another one, and the sale or rental price may not be increased.
The advertiser warrants and represents that the Advertisement complies with all laws and regulations in force and respects the rights of third parties. Accordingly, the advertiser shall hold harmless from any liability LMP Finance, its subcontractors and suppliers and shall indemnify them against any claims and court and legal fees which may result from any action relating to publication of the advertisement and shall compensate them for any damage resulting from a breach hereof.
Without prejudice to the preceding clause, and without creating an obligation on its part to check the content, accuracy and clarity of the Advertisement, LMP Finance reserves the right to refuse an Advertisement for any legitimate reason, and particularly certain portions of the description (words, phrases, sentences, etc.) that may seem contrary to laws or regulations, good morals or the website’s spirit, or that may be susceptible to upset or shock the readers. Such a refusal does not entitle the advertiser to seek compensation.
Right of Rectification
Appartement-meuble.net rejects the use of subjective terms, such as “rare”, “ideal”, “cute”, “great deal”, “negotiable”, “gorgeous”, “magnificent”, “exceptional”, “unbeatable offer”, “extraordinary”, “lovely”, etc., as well as abbreviations, for reasons of clarity. Appartement-meuble.net reserves the right to change any description that does not meet these publication criteria.
LMP Finance reserves the right to suspend or discontinue the publication of its website, Appartement-meuble.net, without being required to pay compensation of any kind whatsoever to the advertiser.
Any claim, in order to be considered valid, must be addressed by letter or email within forty-eight (48) hours from the date of publication on Appartement-meuble.net.
